The Clean Energy Act and what it means for DC building owners
The Clean Energy DC Omnibus Amendment Act demonstrates commitment to address the effects of climate change
After going into effect in March of 2019, the Clean Energy DC Omnibus Amendment Act demonstrates the District’s commitment to address the effects of climate change by setting ambitious mandates to reduce D.C.’s greenhouse gas emissions by 50% by 2032 and achieve carbon neutrality by 2050.
The act establishes a new Building Energy Performance Standard (BEPS) program to set compliance at or above the District’s median ENERGY STAR score. Owners of buildings 50,000 square feet and greater will be required to submit scores for the first cycle beginning in January 2021. Smaller buildings will also need to meet compliance standards: buildings of at least 25,000 square feet by 2027 and buildings of 10,000 square feet by 2033.
What does this mean for you?
Since compliance in 2021 will be determined by 2019 performance, building owners need to stay on top of energy performance, know their ENERGY STAR score and address the situation now. Noncompliant buildings will have five years to prove compliance through a performance or prescriptive pathway. Compliance cycles will reset every six years, so owners must now constantly monitor and improve performance.
